A handy step- by-step guide to explain the stages of your transaction.

There are many reasons for transferring property and it can be sometimes quite complex and very different depending on the reason for the transfer. Here is a quick guide to transferring your property. We will advise and guide you on the best way to deal with your transfer and what is involved as soon as we have your instructions.

Stage one: Following your formal instruction.

Upon receipt of your formal instructions, we will review what kind of transfer we are dealing with and how it is best to proceed for you. We will request your title deeds and a redemption figure from your existing lender and obtain electronic title information from the Land Registry. We will draft your transfer and advise you on it accordingly. When acting for you we cannot also act on behalf of the person being removed. This would be a conflict of interest and we will advise the other person to seek independent legal advice.

We will require your mortgage offer at this stage, if applicable.

Stage Two: Set a completion date

Once we are in receipt of your mortgage offer and signed documents, we can agree a completion date. If you are transferring your property with the aid of a mortgage we will request funds from your new lender and request a redemption statement from your existing lender up until the day of completion.

Stage Three: Completion

On the day of completion, the Transfer Deed is dated and any consideration is dealt with and forwarded to either party should there be a remaining balance due or lump sum payment. We will then submit our application for registration with the Land Registry to register the transfer.
